1. Agreement
These Terms & Conditions ("Terms") form a legally binding agreement between you ("you", "user", "customer") and Little Mirror Books ("we", "us", "our"). By accessing the website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the service.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a contract. By placing an order featuring a child, you represent and warrant that you are the child's parent or legal guardian (or have the parent or legal guardian's express permission) and that you have the right to upload the child's photographs and personal details for the purposes described in the Privacy Policy.
3. The product (AI-generated, expert-reviewed)
Little Mirror Books produces personalized children's storybooks created using artificial intelligence (large language models for text and image-generation models for illustrations) and reviewed by a member of our editorial team prior to delivery. You understand and accept that:
- AI output is probabilistic. Despite human review, illustrations and text may contain artistic interpretations, minor inaccuracies, or stylistic choices that differ from your expectations.
- Books are works of children's fiction created for entertainment and emotional support, not professional therapeutic, medical, psychological, educational, or clinical advice.
- Free revisions are available as described in our Refund Policy.
4. Orders, pricing & payment
Prices are displayed in U.S. dollars unless otherwise stated and are exclusive of any taxes that may apply in your jurisdiction. We reserve the right to change prices at any time; the price shown at checkout is the price you pay. Payment is processed securely by Stripe; we do not store your full card details. Production begins immediately upon successful payment.
5. Delivery
We aim to deliver each book within 48 hours of the completed intake form being submitted, but this is a target, not a guarantee. Occasional delays caused by AI provider outages, high-volume periods, complex revision requests, or factors outside our reasonable control do not entitle you to a refund.
6. License & intellectual property
Upon full payment, we grant you a perpetual, worldwide, non-exclusive, non-transferable license to download, print, and read your finished book for personal, non-commercial family use. You may not resell, sublicense, redistribute, publicly display for profit, or use the book or its illustrations for commercial merchandise, NFTs, training datasets, or any other commercial purpose without our prior written consent.
All underlying templates, prompts, software, branding, and the compilation of the book remain the intellectual property of Little Mirror Books or its licensors.
7. Your content & license to us
You retain ownership of the photos and personal details you upload. By uploading them you grant Little Mirror Books a limited, royalty-free license to use, store, copy, modify, and process them solely for the purpose of producing, delivering, and providing customer support for your book, in accordance with the Privacy Policy. We will not use your child's photos or personal details for marketing, advertising, or AI model training.
You represent and warrant that you have the right to upload all content you submit and that it does not infringe any third-party rights, contains no unlawful material, and depicts only children for whom you are the parent or legal guardian (or have express consent from the parent or legal guardian).
8. Acceptable use
You agree not to:
- Upload images of any person without proper authority and consent.
- Upload sexually explicit, violent, hateful, or otherwise unlawful material.
- Attempt to reverse-engineer, scrape, or disrupt the service.
- Use the service to harass, defame, or harm any individual.
- Resell, sublicense, or distribute the books commercially.
We may suspend or terminate your access and refuse or cancel orders, with or without notice, for any violation of these Terms.
9. Disclaimer of warranties
THE SERVICE AND ALL BOOKS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. NOTHING IN OUR BOOKS CONSTITUTES MEDICAL, PSYCHOLOGICAL, THERAPEUTIC, EDUCATIONAL, OR LEGAL ADVICE. ALWAYS CONSULT A QUALIFIED PROFESSIONAL ABOUT YOUR CHILD'S HEALTH OR DEVELOPMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LITTLE MIRROR BOOKS, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY BOOK, WHETHER BASED ON CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR ANY ORDER SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Little Mirror Books and its owners, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the service, (b) any content you upload, (c) your breach of these Terms, or (d) your violation of any law or third-party right.
12. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service shall first be addressed by good-faith informal negotiation by email. If unresolved within 30 days, the dispute shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Delaware (or remotely), on an individual basis only — class actions, class arbitrations, and representative proceedings are waived to the maximum extent permitted by law. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction for intellectual-property infringement or unauthorized use of the service.
13. Changes to these Terms
We may revise these Terms from time to time. The "Effective date" above reflects the latest version. Continued use of the service after changes constitutes acceptance of the revised Terms.
14. Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Little Mirror Books regarding the service.
